Terms of Service

  1. Acceptance of Terms
    Welcome to iSAT. iSAT provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS. In addition, when using particular iSAT services, you and iSAT shall be subject to any posted guidelines or rules applicable to such services which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS.

  2. Description Of Service
    iSAT currently provides users with access to a rich collection of online resources including various communications tools, online forums, shopping services, personalized content and branded programming through its network of properties (the "Service"). Unless stated otherwise, any new features that augment or enhance the current Service, including the release of new iSAT properties, shall be subject to the TOS. You understand and agree that the Service is provided as is and that iSAT assumes no responsibility for the timeliness, deletion, miss-delivery or failure to store any user communications or personalization settings.

  3. Your Registration Obligations
    In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or iSAT has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, iSAT has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

  4. iSAT Privacy Policy
    Registration Data and other information about you is subject to our Privacy Policy. For more information, see our full Privacy Policy

  5. Member Account, Password & Security
    You will receive a password and account designation upon completion of the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify iSAT of any unauthorized use of your password, account or any other breach of security.

  6. Payment Of Account - South African Bank Account Holders
    Payment of your account will be made by debit order from your bank account, as per the bank details you have supplied upon registration. If your bank details change after registration, you need to contact iSAT and we will fax or email you a "Change of Details" form. Until iSAT confirms that your "Change of Details" form has been processed, you should assume that the next debit order will be processed against your original bank account details.

    The debit order is processed on the 1st of each month, except when the 1st is a Sunday or public holiday. In this case the debit order will be processed on the next working day or Saturday.

    Payments for services rendered are in advance, which means that the first debit order amount will include the full and/or pro rata amount for the current month as well as the full charge for the following month. Details of the amount charged are clearly indicated on the monthly invoice/statement.

    Please note: we do not process debit orders on statements that are in total less than R40.00. If your monthly subscription is less than R40.00 per month, the debit order will not be processed but will accumulate once it totals R40.00 or more.

    iSAT reserves the right to cancel a subscription at any time due to non-payment of an account. iSAT will charge an administration fee for any late payment or if the debit order is returned, and reserves the right to cancel a subscription if a debit order is returned more than once. Non payment of your account could lead to your connection being temporarily suspended and a reconnection fee of R200 will be charged. Accounts overdue for 3 months will be handed over for collection and admin fees (25% of the invoice amount) will be added to the handed over accounts. All legal fees incurred will be for the customer's account.

    Please note we do not monitor service usage and it is therefore the client's responsibility to give notice of cancellation in the due time required.

    Please note all statements, account correspondence and product/marketing correspondence is sent via email to the specified statement email address as specified by you on your completed registration form. We do not send statements via post. Please ensure that you are receiving your statements sent on the 1st day of every month and if this is not the case please contact us to advise us of the correct email address to use for correspondence purposes.

  7. Payment of Account - Foreign Visitors
    Please contact us for pricing and payment methods for short term subscriptions.

  8. Abusive Behaviour
    1. Absolutely no abusive behaviour will be tolerated either via the Internet, email facility or directly with the staff members of iSAT.

      Upon the decision by management to cancel the account as a result of abusive behaviour, the remainder of the subscription for the period paid, will be refunded to the client.

    2. You acknowledge that, iSAT reserves the right, and will take necessary steps, to prevent improper or excessive usage thereof, that may cause other customers to have unfair and unequal use of the service and to protect the integrity of the network.

      The action that iSAT may take includes, but is not limited to:
      • Limiting throughput;
      • Preventing or limiting service through specific ports or communication protocols; and/or
      • Complete termination of service to customers who grossly abuse the network through improper or excessive usage.

      Should the above occur, iSAT reserves the right to:
      • Charge the offending parties for administrative costs as well as for any legal fees incurred should any arise.

  9. Hacking Activity
    People found responsible for hacking, which includes any attempt to break into another computer or port scans will have their accounts suspended immediately. iSAT does not tolerate hacking of any sorts, and will assist the necessary authorities if an investigation is prompted.

  10. Member Conduct
    You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not iSAT, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. iSAT does not control the Content posted via the Service and does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will iSAT be liable in any way for any Content including, but not limited to, any errors or omissions in the Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

    You agree to not use the Service to:
    1. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

    2. harm minors in any way;

    3. impersonate any person or entity, including, but not limited to, an iSAT official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

    4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

    5. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

    6. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;

    7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose;

    8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

    9. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;

    10. interfere with or disrupt the Service, servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

    11. intentionally or unintentionally violate any applicable local, state, national or international law and any regulations having the force of law;

    12. or otherwise harass another; or

    13. collect or store personal data about other users.

    You acknowledge that iSAT does not pre-screen Content, but that iSAT and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, iSAT and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by iSAT or submitted to iSAT.

    You acknowledge and agree that iSAT may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of iSAT, its users and the public.

    You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

  11. Special Admonitions for International Use
    Recognising the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.

  12. Indemnity
    You agree to indemnify and hold iSAT, its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

  13. No Resale of Service
    You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

  14. Modifications to Service
    iSAT reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that iSAT shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

  15. Termination
    You agree that iSAT, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if iSAT believes that you have violated or acted inconsistently with the letter or spirit of the TOS. iSAT may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that iSAT may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that iSAT shall not be liable to you or any third-party for any termination of your access to the Service.

  16. Dealing with Advertisers
    Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that iSAT shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service. 

  17. Links
    The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because iSAT has no control over such sites and resources, you acknowledge and agree that iSAT is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that iSAT shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

  18. Violations
    Please report any violations of the TOS to iSAT.

  19. Cancellation of Services
    We require a 30 day calendar months' notice of intent to cancel any of the services you have requested. Please contact us for a cancellation form to be sent to you, either by email or fax. The cancellation will only be deemed accepted once we have confirmed that we have received your cancellation form, up until that time you will be charged as normal for services rendered, whether you are indeed making use of our services or not.

  20. Warranty
    1. In the event that a Hardare Device is provided to you by iSAT, it will be subject to a manufacturer’s warranty.
    2. It is your responsibility to make sure that you read and understand the warranty provided on your Hardware Device and you hereby indemnify iSAT against all costs and any claim whatsoever arising from your failure to comply with the manufacturer’s warranty.
    3. In the event that you need to return the Hardware Device to possible faults on it, it is a carry-in and collect warranty, unless otherwise stated. i.e. You will be liable to return the Hardware Device to iSAT at your own expense. Same applies with collection.
    4. Should iSAT, in its sole discretion, exchange any Hardware Device, and the manufacturer then establish that any fault or damage to the Hardware Device was caused by you, or is not covered under the warranty, you will be billed for such replacement for Hardware Device.

  21. Business Uncapped Router Operation
    1. Customer shall not have access to the Routers configuration and shall not change or attempt to change the Routers configuration.
    2. In the event that the Router provided comes with built in wireless, iSAT does not support such wireless access.

  22. Risk
    In the event that a Hardware Device is provided to you by iSAT, all risk of loss and/or destruction of the Hardware Device shall be retained by you at all times. You shall be responsible for ensuring the safety of the Hardware Device and shall ensure that the Hardware Device is insured against loss and destruction for the usual causes arising, and shall be liable for the replacement costs of the Hardware Device in the event of any loss or destruction thereof.
     
  23. Static IP
    In order to use the product you must have a router or server that can terminate an L2TP tunnel / connection
    1. Static IP's are only available on the EASY Uncapped ADSL Access options
    2. Only one Static IP can be linked to one active EASY Uncapped ADSL service (username)
    3. The Static IP will remain active as long as the ADSL service (username) it is linked to is active, should the ADSL service (username) it is linked to be cancelled, the Static IP will automatically be cancelled. Please note that once the Static IP is cancelled it cannot be recovered. Should you repurchase the service, a new Static IP will be issued.
    4. The iSAT Support Team will only assist you with the initial setup and maintenance of your L2TP connection and iSAT username on your device. Due to privacy and security concerns, internal network configurations like natting and routing will need to be set up and maintained by your network administrator.
     
  24. Openserve Lines
    Termination conditions for Openserve Fibre connect and Openserve Pure Connect Lines
    1. If the new service is terminated within 6 months of installation, the full installation and activation fee will be recoverable.
    2. For Openserve Fibre Connect this will be R2,979 and for Openserve Pure Connect (Naked DSL) this is R900.
    3. If the service is terminated after 6 months but before 12 months, the above amounts will be recovered pro-rata, in proportion to the remaining period up to 12 months
    4. These amounts will be recovered via invoicing in the month following the cancellation of the respective service(s).
    5. Any migration of services from copper to fibre will however be exempt from the forgoing terms and will therefore be provided unconditionally.
     
  25. Openserve Premium Fibre
    1. 1. Throttling

      1.1 Throttling is the process of limiting the throughput of all services and protocols, the line itself is not affected. Throttling is applied only when an individual user exceeds the Fair Usage Point (FUP) or Usage Thresholds, as further set out in clause 7 below and which may be amended from time to time, on their account, over a calendar month, and even then, only during peak traffic. Just because the Client have reached the FUP point on its account does not mean that the Client will automatically be throttled. Although Openserve do reserve the right to throttle when fair usage has been exceeded, it will only do so at peak network traffic times. When the network is in off-peak times the Client will not be throttled, even if it has exceeded its FUP point. The Client will continue to experience normal speeds. Peak times are daily between 18:00 and 23:00.
      1.2 The Client’s usage between midnight and 06:00 am every day does not affect the Client’s rolling FUP threshold. So, if the Client is planning downloads, it must make sure that it schedules them for these times, so that they won’t impact the Client’s FUP status.

    2. 2. Shaping

      Shaping is the process of implementing priority on certain types of usage or protocols. Openserve may implement shaping to give priority to real-time interactive services, effectively slowing down the Client’s non-prioritized services. This does not relate to the Client’s monthly usage or thresholds, but rather network congestion and will be applied to all services equally. Peak times are daily between 18:00 and 23:00.

    3. 3. Unacceptable Use

      3.1 In addition to clause 6 of the MSA, Services may only be used for lawful purposes and activities. Openserve prohibits any use of its Services including the transmission, storage and distribution of any material or content using Openserve’s network that violates any law or regulation of the Republic of South Africa. This includes, but is not limited to:
      3.1.1 Any violation of local and international laws prohibiting child pornography, obscenity, discrimination (including racial, gender or religious slurs) and hate speech, or speech designed to incite violence or hatred, or threats to cause bodily harm;
      3.1.2 Any activity designed to defame, abuse, stalk, harass or physically threaten any individual in the Republic of South Africa or beyond its borders; including any attempt to link to, post, transmit or otherwise distribute any inappropriate or defamatory material;
      3.1.3 Any violation of intellectual property laws, including materials protected by local and international copyright, trademarks and trade secrets;
      3.1.4 Any violation of another's right to privacy, including any effort to collect personal data of third parties without their consent;
      3.1.5 Any fraudulent activity whatsoever, including dubious financial practices, such as pyramid schemes; the impersonation of another client without their consent; or any attempt to enter into a transaction with Openserve on behalf of another client without their consent;
      3.1.6 Any violation of the exchange control laws of the Republic of South Africa;
      3.1.7 Any activity that results in the sale, transmission or distribution of pirated or illegal material;
      3.1.8 The Service may not be used to provide or resell Services to other individuals, and is prohibited in the following scenarios (but not limited to same), as further set out in clause 5 below:
        3.1.8.1 Wireless Internet Service Provision (WISP);
        3.1.8.2 Providing extended LAN services to adjoining homes;
        3.1.8.3 Hosting shell accounts;
        3.1.8.4 Providing email, news, download, VPN or sandbox services;
        3.1.8.5 Running of home or private servers;
        3.1.8.6 Provision of network services to others; and
        3.1.8.7 Running private servers for mail, HTTP, FTP, IRC and multi-user forums.

    4. 4. Threats to Network Security

      4.1 Any activity which threatens the functioning, security and/or integrity of Openserve network is unacceptable. This includes, but is not limited to:
      4.1.1 Any efforts to attempt to gain unlawful and unauthorised access to the network or circumvent any of the security measures established by Openserve for this goal;
      4.1.2 Any effort to use Openserve equipment to circumvent the user authentication or security of any host, network or account ("cracking" or "hacking");
      4.1.3 Forging of any TCP (Transmission Control Protocol)/IP (Internet Protocol) packet headers (spoofing) or any part of the headers of an email or a newsgroup posting;
      4.1.4 Any effort to breach or attempt to breach the security of another user or attempt to gain access to any other person's computer, software, or data without the knowledge and consent of such person;
      4.1.5 Any activity which threatens to disrupt the Service offered by Openserve through "denial of service attacks"; flooding of a network or overloading a service or any unauthorised probes ("scanning" or "nuking") of others' networks;
      4.1.6 Any activity which in any way threatens the security of the network by knowingly posting, transmitting, linking to or otherwise distributing any information or software which contains a virus, trojan horse, worm, malware, botnet or other harmful, destructive or disruptive component;
      4.1.7 Any unauthorised monitoring of data or traffic on the network without Openserve’s explicit, written consent;
      4.1.8 Running services and applications with known vulnerabilities and weaknesses, e.g. insufficient anti-automation attacks, any traffic amplification attacks, including recursive DNS attacks, SMTP relay attacks; and
      4.1.9 Failing to respond adequately to a denial of service attack (DOS / DDOS).

    5. 5. Action following breach of the AUP

      5.1 Upon the breach of this AUP by the Client and/or its End-users, Openserve may, in its sole and reasonably exercised discretion take any of the following steps:
        5.1.1 Warn the Client, provide information and proof of the incident(s), suspend the Client’s account and/or revoke or terminate the Client’s Service completely;
        5.1.2 In all cases, charge the offending parties for administrative costs as well as for machine and human time lost due to the incident;
        5.1.3 Assist other networks or website administrators in investigating credible suspicions of any activity listed in this AUP;
        5.1.4 Institute civil or criminal proceedings; and
        5.1.5 Share information concerning the incident with other internet access providers, or publish the information, and/or make available the relevant Client and/or End-users' details to law enforcement agencies.
      5.2 This policy applis to and will be enforced for intended and unintended (e.g., viruses, worms, malicious code, or otherwise unknown causes) prohibited usage.

    6. 6. Reservation and Non-Waiver of Rights

      6.1 Openserve reserves the right to amend or alter this AUP at any time.
      6.2 Openserve reserves the right to take action against any individuals, companies or organisations that violate the AUP, or engage in any illegal or unlawful activity while accessing Openserve’s services, to the fullest extent of the law.
      6.3 Openserve reserves the right, at its sole discretion, to act against other types of abuse not listed in this appendix and to investigate or prevent illegal activities being committed over Openserve’s network.
      6.4 Openserve does not waive its right to enforcement of this AUP at any time, or prejudice its right to take subsequent action, should Openserve fail, neglect or elect not to enforce a breach of the AUP at any time.

    7. 7. Usage Threshold(s) or Fair Usage Point(s) (FUP(s))

    8. 8. Exceeding the Usage Threshold(s) or Fair Usage Point(s)

      Once the threshold has been reached, the Service will be downgraded to 20% of the ordered product speed, in accordance with clause 1 above.

     
  26. MTN LTE Wireless
    These product or service specific terms and conditions must always be read together with our General Terms and Conditions, which will always apply to your use of this product or service.
    1. Definitions

      1.1. “Fixed LTE Service” means Long Term Evolution services locked onto a specific MTN Base station(does not allow for roaming) and will make use of the MTN LTE network as defined by MTN. Fixed LTE Services shall only work in areas in which has MTN LTE coverage;
      1.2. “iSAT” refers to Internet Services and Technologies
      1.3. “Calendar Month” means the period from the 1st day of a month to the last day of that month;
      1.4. “Coverage Area” means the area that is validated against the REST based JSON webservice’s LTE procedure call “Coverage”
      1.5. “GB” means gigabytes;
      1.6. “R” or “Rand” means the lawful currency of South Africa;
      1.7. “Network Capacity” means the number of customers or the amount of data that can be delivered to customers in a specific area defined within the Coverage Area, provided with its designated features as may be provided and modified from time to time by iSAT
      1.8. “Services” means the purchase and re-sale of the services packages;
      1.9. “Service Plans” means the plans available
      1.10. “Suspended Service” means the service is no longer active on the network
      1.11. “Terminated Service” means the service is no longer live on the network.
      1.12. “RICA” means the Regulation of Interception of Communications and Provision of Communication-Related Information Act, 70 of 2002.

    2. Suspensive Conditions

      This Agreement are subject to the following Suspensive Conditions:
      2.1. Obtaining of all the relevant permits that may be required for this transaction by the Parties, including, if necessary, regulatory approval;
      2.2. The Coverage Area has been defined

    3. Support Services

      3.1. iSAT shall use its best efforts to ensure that the services are provided optimally throughout the duration of this Service
      3.2. It is recorded that iSAT does not give or make any warranties, representations or guarantees whatsoever, whether implied or express, in relation to the availability, reliability, accuracy and security of the Network Capacity.

    4. iSAT Responsibilities

      4.1. iSAT, through MTN’s network, shall be responsible for providing Fixed LTE on a best efforts basis and based on the exact same Quality of Service provided to all other iSAT Fixed LTE Customers;
      4.2. iSAT shall send an invoice to the Customer at the end of every month for the Service Plan purchased by the Customer;
      4.3. The Customer will follow the defined iSAT support process to log tickets.

    5. Expansion and Coverage:

      5.1. On a monthly basis, iSAT will issue a coverage map that defines the Coverage Area in which Services are available;
      5.2. Selling outside of the Coverage Area will result in Customers receiving no service or an impaired service. Should a customer purchase a service outside the Coverage Area, then iSAT will not be responsible for the quality of the Service which is received or even that Service is made available;

    6. Warranties:

      6.1. iSAT warrants that Service will be made available within the published Coverage Area to Customer on a best effort basis;
      6.2. The Customer warrants that it will undertake all necessary actions to be compliant with the relevant regulations, not limited to RICA. POPI, and CPA acts.

    7. Indemnities:

      iSAT shall not be held responsible or liable for the Operator’s non-compliance with RICA, POPI and other relevant regulatory requirements. As such, the Customer indemnifies iSAT against any claim of whatever nature arising from its non-compliance to these acts.

    8. Product Description:

      iSAT Fixed LTE Service will deliver wireless broadband internet services for Customers within the pre-defined Coverage Areas. All prices are including VAT.

    9. Service plans – Add On Bundles – MTN Fixed LTE

      At any time during a Customer’s valid contract period, the Customer will have access to purchase the following Top-up bundles, (including VAT):

      • 2GB @ R20
      • 5GB @ R50
      • 10GB @ R100
      • 20GB @ R200
      • 50GB @ R500

      Top-up bundles will be valid for one month.

    10. Validity/Expiry on Data Bundles:

      10.1. Any unused monthly data shall be valid for two months;
      10.2. Should a Customer sign up during a month other than on the 1st, the data and the billing will be done pro-rata accordingly for the remaining days of the particular month and the Customer will be billed along with the first full calendar month billing;
      10.3. Carry-Over Data and Top-Up Balances will automatically expire and cease to exist when a capped service is migrated to an uncapped service.
      10.4. Uncapped Data is in no way carried over when an Uncapped service is migrated to a capped service.

    11. Depletion of Data Rules:

      The sequence of data depletion for a given month will be processed as follows:
      11.1. Carry-over base data from previous month used first; then
      11.2. Monthly data allocation (as per subscription) for the current month
      11.3. Top Up carry-over data from the previous month
      11.4. TopUp data purchased in the current month
      11.5. Received Data for a given month will be depleted last

    12. Cancellation:

      Should a Customer decide to cancel their month to month contract, the inclusive monthly data as well as their Top-Up bundles, if applicable, will terminate at the end of the month;

    13. Setup Fee:

      13.1. A Setup fee will be charged to the Customer on all LTE Packages, this includes the SIM and delivery of the SIM.
      13.2. Should a Customer cancel an order on delivery as a result of lack of coverage or inadequate coverage, and the sale was made outside of the defined Coverage Area, then all incurred costs will be recovered from the Customer. iSAT will not take responsibility for any damage done to a Customer’s property by any third party vendors.

    15. SIM & Modem:

      14.1. The SIM is registered to the cell-tower and a slot will be allocated as such
      14.2. The service will be activated within 48 hours of delivery
      14.3. SIM’s are network locked to a specific tower; notifications will be available when mobility is detected
      14.4. Should a SIM move from the allocated tower, the SIM will be de-activated as soon as mobility is detected
      14.5. Once a SIM has been deactivated due to mobility, a new SIM will need to be issued to reinstate access

      14.7. If using your own router, ensure it is not Network Locked. If Network Locked, you will not be able to complete setup.

    16. Data Transfer restriction:

      15.1. Data from uncapped products cannot be transferred.
      15.2. Data cannot be transferred from a capped package to an uncapped package.

    17. Uncapped Shaping rules

      MTN Uncapped Premium 25Mbps LTE:
      16.1.1. The maximum throughput speed on this service is up to 25Mbps.
      16.1.2. There are no guarantees on speeds, this is a best effort service – this depends on the favorability on the network in the client’s area, device capability, etc.
      16.1.3. Peer-to-Peer, NNTP, Torrents, etc. are limited to 128kbps on this service.
      16.1.4. The above rules apply to all hours of usage, without exclusion.

      MTN Uncapped Lite 10Mbps LTE:
      16.2.1. The maximum throughput speed on this service is up to 10Mbps. 16.2.2. There are no guarantees on speeds, this is a best effort service – this depends on the favorability on the network in the client’s area, device capability, etc. 16.2.3. Peer-to-Peer, NNTP, Torrents, etc. are limited to 128kbps on this service. 16.2.4. All Real-Time Entertainment services, video streaming and music streaming are limited to 4Mbps. 16.2.5. The above rules apply to all hours of usage, without exclusion.

  27. RAIN LTE-ADVANCED Wireless
    These product or service specific terms and conditions must always be read together with our General Terms and Conditions, which will always apply to your use of this product or service.
    1. Definitions:

      1.1. ”4G LTE” means wireless broadband technology used to connect the CPE to the network;
      1.2. “iSAT” refers to Internet Services and Technologies
      1.3. “Calendar Month” means the period from the 1st day of a month to the last day of that month;
      1.4. “Coverage Area” means the coverage area in South Africa within which iSAT is providing the service, as it may be notified at any specific time;
      1.5. “Customers” shall mean customers to be acquired by the Operator for the provision of Services in terms of this Service Schedule;
      1.6. “Execution Date” means the date of execution of this Service Schedule by the last Party;
      1.7. “GB” means gigabytes;
      1.8. “R” or “Rand” means the lawful currency of South Africa;
      1.9. “Network Capacity” means the number of customers or the amount of data that can be delivered to customers in a specific area defined within the Coverage Area, provided with its designated features as may be provided and modified from time to time by iSAT
      1.10. “Services” means the purchase and re-sale of the services packages;
      1.11. “Services Plans” means the plans available
      1.12. “Suspended Service” means the service is no longer active on the network
      1.13. “Terminated Service” means the service is no longer live on the network.

    2. Suspensive Conditions:

      This Agreement are subject to the following Suspensive Conditions:

      2.1. Obtaining of all the relevant permits that may be required for this transaction by the Parties, including, if necessary, regulatory approval;
      2.2. The Coverage Area has been defined and agreed within which the Operator can undertake sales;

    3. Support Services:

      3.1. iSAT shall use its best efforts to ensure that the services are provided optimally throughout the duration of this Service
      3.2. It is recorded that iSAT does not give or make any warranties, representations or guarantees whatsoever, whether implied or express, in relation to the availability, reliability, accuracy and security of the Network Capacity.

    4. iSAT Responsibilities:

      4.1. iSAT shall be responsible for providing 4G LTE on a best efforts basis and based on the exact same Quality of Service provided to all other ISAT 4G LTE customers;
      4.2. iSAT shall send an invoice to the Client at the end of every month for the Service Plans purchased by the Client.
      4.3. The Operator will be responsible to bill and collect payment from their Customers, and address any billing and payment related support queries;
      4.4. The Operator will follow the defined iSAT support process to log tickets.

    5. Expansion and Coverage:

      5.1. Monthly, iSAT will issue a coverage map that defines the Coverage Areas in which Services are available;
      5.2. Selling outside of the Coverage Area will result in Customers receiving no service or an impaired service. Should a customer purchase a service outside the Coverage Area, then iSAT will not be responsible for the quality of the Service which is received or even that Service is made available;

    6. Warranties:

      6.1. iSAT warrants that Service will be made available within the published Coverage Area to Customers on a best effort basis;
      6.2. The customer warrants that it will undertake all necessary actions to be compliant with the relevant regulations, not limited to RICA. POPI, and CPA acts.

    7. Indemnities:

      iSAT shall not be held responsible or liable for the Customers non-compliance with RICA, POPI and other relevant regulatory requirements. As such, the customer indemnifies iSAT against any claim of whatever nature arising from its non-compliance to these acts.

    8. Service Plans - Add on Bundles:

      At any time during a Customer’s valid contract period, the Customer will have access to purchase the following Add On bundles (including VAT): 1GB @ R10.00, 2GB @ R20.00, 3GB @ R30.00, 5GB @ R50.00, 10GB @ R100.00, 20GB @ R200.00

      The validity period of Top-up bundles shall remain at 30 days from the date of purchase. In the event of a Top-up bundle being carried over to the next month, the Top-up bundle shall be depleted first before depleting the monthly allocated data.

    9. Validity/Expiry on Data Bundles:

      Where a customer has not used their entire monthly allocation of data from their package, it shall not expire in the same calendar month, but rather expire in the following month. For example, if a subscriber with a 55GB package allocated for the period 1 to 30 June, has 5GB of their data package remaining, the 5GB shall be valid until 31 July at 23:59.

      The maximum roll-over period for unused data is one additional calendar month. Following this period, unused data will be forfeited.

      Should a Customer sign a contact during a month other than on the 1st, the data and the billing will be done pro-rata accordingly for the remaining days of the month and the Customer will be billed along with the first full calendar month billing;
      Any unused Add on bundle shall be forfeited at 23:59 on the expiry date.

    10. Depletion:

      - Top-up bundle depleted first, if applicable.
      - Carry-over data will be depleted second, if applicable.
      - Monthly data allocation will be depleted last.

    11. Cancellation:

      Should the Customer decide to cancel their month to month contract, the inclusive monthly data as well as their Top-Up bundles, if applicable, will terminate at the end of the month;
